1. Who we are and what Unlabeled is

Unlabeled is an online marketplace operated by [TITULAR — full legal name], [autónomo / SL], NIF [NIF], registered address [ADDRESS], contact [EMAIL] (“Unlabeled”, “we”, “us”). Unlabeled provides the technical platform that lets independent sellers list vinyl records and lets buyers find and purchase them. Unlabeled is an intermediary, not the seller. We do not own, hold, inspect, store, or ship the records, and we do not take possession of buyers’ payments.

2. The contract is between buyer and seller

Every purchase is a direct contract of sale between the buyer and the seller of that listing. The seller is the seller of record and is solely responsible for: the accuracy of the listing; the description, condition, provenance and authenticity of the record; pricing; packing and shipping; issuing any required invoice; and handling cancellations, returns and refunds. Unlabeled is not a party to that contract and gives no warranty over the items sold.

3. How an order works

A buyer places a request; the seller confirms the exact shipping cost; the buyer then pays the final total. Payment is processed by PayPal and settles directly into the seller’s own PayPal account. Unlabeled never receives or holds the funds. Title and risk in the record pass according to the contract between buyer and seller.

4. Fees

Using Unlabeled is currently free for buyers and sellers (0% commission). If we introduce a platform fee, it will be charged as a commission to the seller for the intermediation service, disclosed in advance, and routed via PayPal; it does not make Unlabeled the seller of the record.

5. Consumer rights (B2C)

Where the buyer is a consumer, the statutory rights under Spanish and EU consumer law — including the right of withdrawal and the legal guarantee of conformity — apply against the seller, who must honour them. Buyers acquiring records in the course of a business may indicate this at checkout, in which case consumer-specific rights may not apply to that purchase.

6. Seller obligations and prohibited items

Sellers warrant they have the right to sell each record and that the sale does not infringe any third party’s intellectual property. Counterfeit, bootleg, or otherwise unauthorised pressings, and any unlawful content, are prohibited. Sellers must provide accurate trader identity information as required by EU marketplace rules.

7. Reporting and takedown

Anyone may report a listing they believe is infringing or unlawful via the “Report this listing” control. We review reports and may remove listings and suspend accounts. As a hosting intermediary we are not obliged to monitor content proactively, but we act on notices we receive.

8. Limitation of liability

To the maximum extent permitted by law, Unlabeled is not liable for the acts or omissions of sellers or buyers, for the quality, legality, safety or authenticity of records, or for the performance of any sale. Nothing here excludes liability that cannot be excluded by law.

9. Governing law

These Terms are governed by Spanish law. Mandatory consumer-protection rules of the buyer’s country of residence are unaffected.
